THE NATIONAL ENVIRONMENT MANAGEMENT COUNCIL (NEMC)

The National Environment Management Council (NEMC) is a national environmental regulatory and enforcement institution responsible for controlling, managing and protecting environment in Tanzania.

The purpose for which the Council was established is stipulated in Section 17(1) of EMA Cap.191 of 2004 and inter alia includes:  to undertake enforcement, compliance, review and monitoring of environmental impact assessment, facilitation of public participation in environmental decision making, exercise general supervision and coordinate overall matters relating to the environment.

About NEMC

The National Environmental Management Council (NEMC) was established by the National Environmental Management Law no. 19 of 1983 as a tool to advise the government on issues of sustainable environmental care. The Council officially began work in 1986. Law no. 19 of 1983 was repealed in 2004 by the Environmental Management Law No. 20 of 2004 (Chapter 191) which established the Council once again. This new law gave the Council the legal power to manage the environmental protection in the country

Since its inception, the Council has been supervising and giving advice to the government on the entire issue of environmental conservation in the country. In accordance with article 17 of the Law, the purpose and reason for establishing this Council is to coordinate the implementation of environmental policies and laws in four main areas:-

  • To carry out the activities of compliance and management (enforcement and compliance) of the Environmental Management Law;
  • Managing the Environmental Impact Assessment (TAM) process (Coordinating, reviewing TAM reports from project owners and monitoring their implementation);
  • Facilitating public participation in making decisions about the environment and managing in general and
  • Coordinating all issues related to the environment in accordance with the Environmental Management Act and any other written laws.

 

In addition, section 18 (2) of the Environmental Management Law, provides a broad breakdown of the Council’s responsibilities as follows: –

  • Conducting environmental audits (Environmental Audit), Conducting assessments that will help in conservation and management,
  • Conducting research and coordinating research of environment, investigate, evaluate and collect information and research results and distribute them to stakeholders,
  • Review and make recommendations to facilitate the adoption of TAM information/reports), Identify projects or programs that need to be audited and monitored (Audit and Monitoring).. Read more about NEMC
